Terms and Conditions for Individuals

These General Terms and Conditions of Sale (T&Cs) apply to all orders and deliveries between NATURAL BREED Patrice Le Rest and its individual customers of the online store naturalbreed.com.

These general terms and conditions of sale may be revised by NATURAL BREED at any time and without notice.

1. Ordering Process

NATURAL BREED offers its customers a selection of items intended for pets. The customer can access details regarding the product, such as its presentation, by clicking on the products or item descriptions. When the customer selects the desired quantity and clicks on the shopping cart icon, the product is placed in a virtual basket.

By clicking on the "my cart" button in the online store, located at the top right of the screen, the customer accesses a summary page and can verify at any time which items are in their virtual basket and, if necessary, make changes.

If the customer wishes to complete their purchase, they can proceed by clicking the "Checkout" button. Registered customers can enter their username and password to use their saved information to place the order. The customer can also register as a new customer and create a customer account or proceed without creating an account. In this case, the customer must enter their address and billing information on the following page.

By clicking again on the "next" button, the customer reaches the penultimate step of the order: "Overview." The customer then receives a summary of their order with the total price (including legal VAT) as well as information about service and delivery charges.

The order is completed when the customer clicks on the "Place order" button. A firm offer is then submitted.

2. Pricing

Prices are expressed in Euros. The price shown on the product pages does not include shipping. The price indicated in the order confirmation is the final price, expressed inclusive of all taxes, including VAT for France. This price includes the cost of the products, handling, packaging, and shipping.

"Welcome Offers": NATURAL BREED regularly offers a "Welcome Offer" as part of its commercial policy. These offers are reserved for new customers, individuals (non-professionals), delivered in mainland France (excluding Corsica and overseas territories). Offer valid only once per household or entity (same name, address, or phone number). Not combinable with other current offers, promotions, or credits. In case of non-compliance with the conditions of the "Welcome Offer," NATURAL BREED reserves the right to cancel the order and deactivate any duplicate customer accounts.

3. Delivery

3.1 Shipping Fees

NATURAL BREED delivers without a minimum order amount (excluding shipping fees). Delivery in mainland France is free for any order of 80 EUROS or more with DPD or GLS. If an order must be delivered in several shipments for technical or logistical reasons, no additional shipping fee will be charged to the customer.

3.2 Delivery Time

Orders are shipped upon full payment, generally within 24 to 72 working hours for items in stock. The usual delivery time observed is 24 to 72 hours for orders under 100 kg. Note that shipping times may be extended from the end of November to the end of December.

3.3 Delivery Methods

Home delivery: Repeated absence of the customer during delivery results in the return of the products to NATURAL BREED.
Parcel relay delivery: Parcels are kept for only 8 days in relay points; after this period, unclaimed parcels are returned to NATURAL BREED.

If needed:

  • DPD Customer Service: 09 70 80 85 66 (non-premium rate call)

  • GLS Customer Service: 08 06 006 006 (premium rate call and will not be reimbursed; we advise contacting our logistics department for any issues with GLS delivery).

3.4 In case of absence, our carrier may leave the package at a relay point upon your request.

A delivery notice will be left in your mailbox, and a second delivery attempt will be scheduled. You may also be notified by SMS. After two failed delivery attempts, the package will be returned to NATURAL BREED. To avoid such inconvenience, we recommend delivery to your workplace or to a trusted person. It is also strongly advised to provide landline and mobile phone numbers so the driver can contact you if necessary.

If the delivered items have been damaged during transport, NATURAL BREED must be informed as soon as possible. You must write reservations on the driver's delivery slip and, if possible, specify what is damaged. NATURAL BREED will then be able to file a claim with the carrier or transport insurance. If the customer does not declare transport damage, this negligence will not affect their legal warranty rights.

3.5 Articles L221-15 and L216-1 and following apply

Article L221-15
The professional is fully responsible to the consumer for the proper performance of the obligations resulting from the distance contract, whether these obligations are performed by the professional who concluded the contract or by other service providers, without prejudice to their right of recourse against them. However, they may be exempt from all or part of their liability by proving that the failure or improper performance of the contract is attributable either to the consumer, or to the unforeseeable and unavoidable act of a third party, or to a case of force majeure.

Article L216-4
Any risk of loss or damage to the goods is transferred to the consumer at the moment the latter or a third party designated by them, other than the carrier proposed by the professional, physically takes possession of the goods.

4. Right of Withdrawal

Customers are consumers and therefore have a fourteen-day right of withdrawal. A "consumer" is defined as any natural person who enters into a legal transaction for purposes that cannot be attributed to their industrial, commercial, artisanal, or liberal professional activity. The following regulations regarding the right of withdrawal and its exclusions apply.

The right of withdrawal is provided for in Article L221-18 of the Consumer Code

Article L221-18
Created by Ordinance No. 2016-301 of March 14, 2016
The consumer has a period of fourteen days to exercise their right of withdrawal from a distance contract, following a telephone solicitation or concluded off-premises, without having to justify their decision or incur costs other than those provided for in Articles L. 221-23 to L. 221-25.

The period mentioned begins on the day:
1° The contract is concluded, for service contracts and those mentioned in Article L. 221-4;
2° The goods are received by the consumer or a third party, other than the carrier, designated by them, for contracts of sale of goods.
For off-premises contracts, the consumer may exercise the right of withdrawal from the conclusion of the contract.

Article L221-23
The consumer must return or hand over the goods to the professional or a person designated by them without undue delay and, in any event, no later than fourteen days from the date of communication of the decision to withdraw in accordance with Article L. 221-21, unless the professional offers to collect the goods themselves.
The consumer only bears the direct cost of returning the goods, unless the professional agrees to bear them or failed to inform the consumer that these costs would be borne by them. However, for off-premises contracts where goods are delivered to the consumer's home when the contract is concluded, the professional collects the goods at their own expense if they cannot be returned normally by post due to their nature.

The consumer's liability is only engaged in the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the goods, provided the professional has informed the consumer of their right of withdrawal, in accordance with 2° of Article L. 221-5.

In case of refusal of the parcel, return costs of €28 will be charged (deducted from the refund of your invoice).

You are duly informed that the consumer is required to return the item to the professional within 14 days, bearing the return costs.

The seller is liable for any non-conformity of the goods under the conditions set out in Articles L. 217-4 to L217-14 of the Consumer Code and for hidden defects under the conditions provided for in Articles 1641 and following of the Civil Code.

Article L217-9
In the event of non-conformity, the buyer chooses between the repair and the replacement of the goods. However, the seller may refuse the buyer’s choice if it entails a cost clearly disproportionate compared to the other option, given the value of the goods or the significance of the defect. The seller is then required to proceed, unless impossible, with the option not chosen by the buyer.

If they refuse, the order will be automatically canceled, and the customer will be notified by email. In addition, NATURAL BREED reserves the right to refuse any order from a customer with whom there is an ongoing dispute.

8. Disputes

Complaints or disputes will always be received attentively, as good faith is always presumed in the person who takes the time to explain their situation. In the event of a dispute, the customer will contact the company first to seek an amicable solution.
